DECLARATION ON THE PROCESSING OF PERSONAL DATA

Declaration on the Processing of Personal Data pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council on the Protection of Natural Persons with Regard to the Processing of Personal Data and on the Free Movement of Such Data (hereinafter referred to as “GDPR”)
1. Personal Data Controller
The controller of personal data is Jan Kričfaluši – LINECOM (hereinafter referred to as the “Controller”), who hereby, in accordance with Article 12 of the GDPR, informs you about the processing of your personal data and your rights.

In processing personal data, we respect and adhere to data protection standards and follow these principles: personal data is always processed for a clear and understandable purpose, using defined means and methods, and only for the time necessary. The personal data of our clients and employees is collected only to the extent necessary and is not shared with third parties, except those directly involved in company processes requiring necessary processing.

Cooperating individuals (employees, subcontractors) are obliged to adhere to the principles of data processing defined by the Controller and undergo regular training.

The company has established a Data Protection Officer (DPO) responsible for overseeing the proper protection of personal data. Contact details of the DPO are publicly available on the Controller’s website.

2. Scope of Personal Data Processing
Personal data is processed to the extent provided by the data subject in connection with the conclusion of contractual or other legal relationships with the Controller, due to legitimate interest, or otherwise collected by the Controller in accordance with applicable legislation or to fulfill legal obligations.

Directly from data subjects (e.g., registration, contact forms, emails, phone calls, business cards, etc.)
Public registers and records (e.g., Commercial Register, Trade Register, Real Estate Register)
Automated recording of electronic communication under Act No. 127/2005 Coll. and Decree No. 357/2012 Coll.

Address and identification data (e.g., name, surname, title, birthdate, permanent address, identification number, VAT number)

6. Method of Data Processing and Protection
Data is processed by the Controller at its offices, branches, or headquarters through authorized personnel or processors. Processing may occur digitally or manually, following strict security measures to prevent unauthorized access, alteration, destruction, or misuse of personal data.

The Controller has implemented technical and organizational measures to ensure data protection, such as preventing unauthorized access or transmission.

7. Retention Period for Personal Data
Personal data is retained for the duration of the contractual relationship or as required by law, but no longer than 10 years after the relationship ends.

8. Sharing Personal Data with Third Parties
Data is only shared with processors or service providers to the necessary extent, ensuring compliance with GDPR principles.

9. Transfer of Data Abroad
Personal data is primarily processed within the EU. In cases where servers are located outside the EU (e.g., in the USA), GDPR-compliant measures, such as the Privacy Shield, are applied.

10. Legal Basis for Processing
Data is processed with the consent of the data subject unless processing is permitted by law under Article 6(1) of the GDPR.
